Dear members,

Spring is in the air, which means that business (and busy-ness) is ramping up in the Kootenay and Boundary real estate markets. 

A heavy workload can sometimes make us cut corners, but with all eyes on the real estate industry, it's more important than ever that we dot our i's and cross our t's.

In this month's newsletter, we are starting something new: the directors recently approved a communication policy with respect to the Professional Standards Committee which includes publishing a summary of the outcomes. The intention behind this policy is not to name and shame, but to help keep KAR members apprised of the rules and the potential consequences of not following them. In this issue of the KAR newsletter, we have shared two cases that were recently heard by members of the Professional Standards Committee and the lessons learned from each one.

The KAR Member Portal is the main resource for all your education information, and it includes a calendar of the monthly courses offered by both associations.

There are two new features available to KAR members:



1.   Xposure Meet - one-on-one virtual meetings are now available directly from Xposure via the "Clients" tab. Simply click on your client's name, select the "Meet (Beta)" tab and follow the easy instructions outlined on your screen. 


2.   CMA Comparables - now you can easily import the comparables shown on an Xposure listing website directly into the CMA module. When you select "Comparables" from the listing website the results will open up in Xposure's search display from which you can "Add to a CMA" from the "Actions" button. 


The latest tool in your KAR toolbox: the ReallyTrusted app promises to streamline the process of filling in your regulatory forms. Visit the KAR Member Portal to sign up for training.

MLS® Department


What do you need to do when a sale collapses?

KAR's MLS® Rule 3.2 states: The Listing Brokerage must notify KAR immediately of the collapse of any sale. Where the Cooperating Brokerage has first knowledge of the collapse of a sale, they shall immediately notify the Listing Brokerage.

Please ensure you provide the MLS® Collapsed Sale Report to the KAR office for processing - this form can be found on WEBForms®.


Professional Standards

The KAR Professional Standards Committee has provided decisions on several complaints, the results of which are noteworthy and could assist other members.


Case #1:

Both a REALTOR® Member and the member’s broker were found to have breached Article 12 (Skilled and Conscientious Service) of the Standards of Business Practice by showing a property without arranging a showing in advance with the listing agent and leaving the buyers alone in the property. Though this was a home under construction and the buyers had viewed the home several times prior to this showing, the Respondents acknowledge that they should have made the appropriate arrangements to show the property and remain on-site with the buyers for the duration of the showing.


By way of Consent Order, the Realtor® member was fined $1500, and both the Realtor® member and the broker are required to complete the course, Ethics: Unlocking the REALTOR® Code.


It is important to remember that regardless of the relationship you have with your clients, the number of times they have viewed a property or the situation of the property (vacant, under construction, etc), a showing must be arranged with the listing Realtor®. Additionally, a Realtor® must always accompany a non-member while accessing a property. A client should not be left alone in a property at any time.


Case #2:

This complaint was dismissed as there was not enough evidence to support the claims. There would typically not be any publication of a complaint that did not result in sanction but this case brought to light a good warning/reminder for our members.


The complaint involved a unit in a yet-to-be-built development that was listed on the MLS® System but sold directly to the buyer by the developer. There was no misconduct found but it did come to light that a reminder of MLS® Rule 1.18: Contingent Listings may be warranted.  A contingent listing is to be identified in the REALTOR® remarks; in this case, the fact that the owner can sell the property himself.
